Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) regulates the rights and obligations of the parties, in accordance with Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts, regarding the remote (online) sale of products and services sold by ALPAT Health Group through the alpatsaglik.com website and the ALPAT Health mobile application.

Buyer (Consumer):
The person who purchases a product/service through the website or mobile application.

2. Subject of the Agreement

The subject of this agreement is the determination of the rights and obligations of the parties regarding the characteristics, sales price and delivery of the product or service ordered by the Buyer through the ALPAT Health website or mobile application.

3. Product and Service Information

The products and services subject to sale may include:

  • Medical and health products,
  • Cosmetic and care products,
  • Dental health products,
  • Supportive health products,
  • Digital health service packages,
  • Advance payments for health services provided by appointment.

The name and quantity of the purchased product or service, the sales price including all taxes, and the payment information are stated in the confirmation form transmitted to the Buyer's screen and e-mail address at the time of purchase.

4. Delivery and Performance Conditions

  • Product delivery is made to the address specified by the Buyer, depending on stock availability.
  • For products dispatched, the shipping time is generally 1–5 business days.
  • For service purchases (e.g. an appointment or service package), the service is performed by ALPAT units.
  • The Seller is not responsible for delays experienced due to the Buyer providing an incorrect address.

5. Payment Information

  • All prices are stated in Turkish Lira.
  • In payments made by credit card, card information is not recorded by ALPAT.
  • Payment transactions are carried out through the secure infrastructure of contracted banks or payment institutions.
  • The Buyer is obliged to pay the total amount specified at the time of order and the shipping fee, if any.

6. Right of Withdrawal

The Buyer has the right of withdrawal under the following conditions:

  • The right of withdrawal can be exercised within 14 days of the delivery of the product without giving any reason.
  • The right of withdrawal is valid only for products whose packaging has not been opened, whose hygienic integrity has not been compromised, and which are in resalable condition.
  • Health services, custom-prepared products and hygiene supplies are outside the scope of the right of withdrawal.
  • The Buyer must notify their withdrawal request in writing or by e-mail: [email protected]

Products and services for which the right of withdrawal cannot be used:

  • Health services whose performance has begun, such as dental, home health or beauty services,
  • Perishable products,
  • Cosmetic products whose packaging has been opened or which have been used,
  • Custom-made laboratory products (prostheses, etc.).

7. Return Conditions

  • The product to be returned must be sent with its original packaging and invoice.
  • After the return is approved, the refund is made within 14 days.
  • The shipping fee is covered by the Seller within the scope of the right of withdrawal.
  • In the event that the product is damaged by the Buyer, the return may not be accepted.

8. Obligations of the Buyer

  • To provide accurate address and contact information at the time of order,
  • To check the product received and notify immediately in case of a defect,
  • To arrive on time for service appointments or cancel them appropriately.

9. Obligations of the Seller

  • To deliver the purchased product undamaged and complete,
  • To provide the services on time as specified,
  • To make the refund on time within the scope of the right of withdrawal,
  • To protect the Buyer's personal data in accordance with the legislation.

10. Warranty and Defective Product

  • If the product is defective, the Seller offers free replacement, repair or refund options.
  • Notification of a defective product must be made within 30 days.

11. Protection of Personal Data

The Buyer's personal data is processed within the scope of the KVKK solely for the purpose of providing the service and carrying out order transactions. Details are set out in the Privacy Policy.

12. Force Majeure

In situations such as natural disasters, epidemics, war, strikes, power outages, congestion or technical infrastructure problems, the Seller may experience delays in providing the service. Such situations are considered force majeure and the Seller cannot be held responsible.

13. Resolution of Disputes

In disputes that may arise between the parties, the Consumer Arbitration Committees and Consumer Courts located in the region where the Buyer resides are competent.

14. Entry into Force of the Agreement

When the Buyer confirms the order, they are deemed to have accepted all the terms of this agreement. A copy of the agreement is presented to the Buyer on the order confirmation screen.
